The terms that govern your use of the Magnolia Processing website.

These Terms of Use ("Terms") govern your access to and use of the website at magnoliaprocessing.com (the "Site"), operated by Magnolia Processing ("Magnolia," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. About Magnolia and the Site

Magnolia Processing is a third-party contract mortgage loan processing company that provides processing support to licensed mortgage loan originators, brokers, and lenders in Florida and Texas. The Site is provided for general informational purposes about our services.

Magnolia is not a mortgage lender or broker. We do not originate, offer, or negotiate mortgage loans, do not take loan applications, do not issue loan approvals or commitments, and do not make credit decisions. Nothing on the Site is an offer or commitment to lend, or an advertisement for consumer mortgage credit. Our services are offered to mortgage professionals, not to consumers seeking a loan.

3. No professional advice

Content on the Site is provided for general information only and is not legal, financial, tax, compliance, or other professional advice. You should consult your own advisors before acting on anything you read here.

4. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any way that violates applicable law; attempt to gain unauthorized access to the Site or its systems; interfere with or disrupt the Site; introduce malicious code; scrape or harvest data except as permitted; or use the Site to transmit unsolicited communications.

5. Submissions

If you submit information through a form or otherwise contact us through the Site, you represent that the information is accurate and that you have the right to provide it. Do not submit confidential borrower information, Social Security numbers, financial account numbers, or other sensitive personal data through the Site. 6. Scheduling and third-party services

The Site links to and embeds third-party services, including Microsoft Bookings for scheduling calls. Those services are governed by the third party’s own terms and privacy policies, and we are not responsible for them. Links to other websites are provided for convenience and do not imply our endorsement.

7. Intellectual property

The Site and its content — including text, graphics, logos, and design — are owned by Magnolia Processing or its licensors and are protected by intellectual property laws. You may view and use the Site for your own informational purposes, but you may not copy, reproduce, distribute, or create derivative works from it without our prior written permission.

8. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on it is complete or current.

9. Limitation of liability

To the fullest extent permitted by law, Magnolia Processing and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Magnolia Processing and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.
